Before the Court is Defendants SAP America, Inc. and SAP, AG’s (“SAP’s”) claim of inequitable conduct. The Court conducted a bench trial on April 27, 2010 on SAP’s claim of inequitable conduct and the parties submitted briefing supporting their positions prior to the trial. (Dkt. Nos. 352, 358, 367, 371). For the following reasons, the Court DENIES Defendants’ claim of inequitable conduct on the ‘400 and ‘350 patents. 1 I.
