Pending before the Court is Defendant’s Fed. R. Civ. P. 50(b) and 5 9(a) Motions (Dkt. #875). Having considered the motions and relevant pleadings, the Court finds they should be DENIED. BACKGROUND On June 3, 2004, the parties entered into a letter “Confidentiality Agreement” to explore a possible business relationship. Pursuant to the terms of the Confidentiality Agreement, the parties exchanged confidential information.
