I. Introduction Pending before the court is the plain tiff MHL Tek, LLC’s (“MHL”) motion for reconsideration (Dkt. No. 278) of the order dism issing claims one and three (Dkt. No. 269). The court held an evidentiary hearing on September 16, 2009 and heard evidence relating to the motions to dismiss. For the following reasons, the motion to reconsider is DENIED. II.
