This Amended Memorandum Opinion and Order is identical to the Memorandum and1 Order entered on October 4, 2005 with the exception that prior footnote 7 has been deleted and the Court has included a deadline for payment of the monetary sanction described on page 27 of this Amended Memorandum Opinion and Order. That portion of prior footnote 7 which appeared in the October 4, 2005, Memorandum Opinion and Order was a typographical error.
