Before the Court is the opening claim construction brief of Foundation Medicine, Inc. (“Plaintiff”) (Dkt. No. 72, filed on April 6, 2017), 1 the response of Guardant Health, Inc. (“Defendant”) (Dkt. No. 77, filed on April 20, 2017), and the reply of Plaintiff (Dkt. No. 80, filed on April 27, 2017 ). The Court held a hearing on the issues of claim construction and claim definiteness on May 18, 2017. Having considered the arguments and evidence presented by the parties at the hearing and in their briefing, the Court issues this Order.
