I. INTRODUCTION Pending before the Court are: (1) plaintiff Function Media, L.L.C.‘s (―FM‖) motion for judgment as a matter of law (―JMOL‖) on validity (Dkt. No. 409); (2) defendant Google, Inc.‘s (―Google‖) motion for JMOL regarding invalidity (Dkt. No. 412); (3) Google‘s motion for JMOL on non-infringement (Dkt.
