Before the Court is Defendant Dell’s Objection to the Magistrate Judge’s Report and Recommendation Regarding Defendant’s Motion for Summary Judgment of Invalidity. Dkt. No. 245. Also before the Court are Plaintiff Abstrax’s Response, Dell’s reply and the parties’ additional briefing on the motion. Dkt. No. 170, 183, 192, 202, 265 and 270.
