This claim construction opinion construes the disputed claim terms in U.S. Patent No. 6,760,728 (“the ‘728 patent”). Plaintiff SmartPhone Technologies, LLC (“SmartPhone”) alleges that Defendants1 infringe the ‘728 patent.2 The parties have presented their claim construction positions (Doc. Nos. 99, 104 & 110). On November 15, 2013, the Court held a claim construction hearing and later issued a provisional claim construc tion order (Doc. No. 120). For the reasons stated herein, the Court adopts the constructions set forth below.
