Pending before the Court is Defendants’ Motion to Dismiss Plaintiff’s Second Amended Complaint (Dkt. #27). Having considered the Motion and the relevant pleadings, the Court finds that the Motion should be DENIED. BACKGROUND This is a trademark and patent infringement case, revolving around the sale and marketing of powered cover plates (Dkt. #20). Plaintiff, Snap Rays, LLC, manufactures and sells powered cover plates, which are electrical outlet covers that include LED lighting , light sensors, and even USB charges (Dkt. #20 at ¶ 10).
