Pending before the Court is Defendant Liberty Mutual Group Inc.’ s Motion to Dismiss Plaintiff’s Complaint (Dkt. #10). Having considered the motion and the relevant pleadings, the Court finds the Motion should be DENIED. BACKGROUND On August 17, 2020, RFC Lenders of Texas, LLC ( “RFC”) sued Liberty Mutual Group Inc. (“Liberty Mutual ”) (Dkt. #1). On November 9, 2020, Liberty Mutual filed its Motion to Dismiss (Dkt. #10). On December 14, 2020, RFC responded (Dkt. #19).
