Pending before the Court is Defendant State Farm Mutual Automobile Insurance Co.’ s Motion to Dismiss Plaintiff’s Amended Complaint (Dkt. #17). Having considered the motion and the relevant pleadings, the Court finds the Motion should be DENIED. BACKGROUND On August 17, 2020, RFC Lenders of Texas, LLC ( “RFC”) sued State Farm Mutual Automobile Insurance Co. ( “State Far m”) and filed an amended complaint (Dkt. #2). On November 9, 2020, State Farm filed its Motion to Dismiss (Dkt. #17). On December 14, 2020, RFC responded (Dkt. #26).
