Pending before the Court is Defendant PetSmart, Inc. ’s Motion to Dismiss (Dkt. # 7). Having considered the motion and the relevant pleadings, the Court finds the Motion should be DENIED. BACKGROUND On May 27, 2020, Consolidated Transaction Processing LLC (“CTP”) sued PetSmart Inc. (“PetSmart”) (Dkt. #1). On October 13, 2020, PetSmart filed its Motion to Dismiss (Dkt. #7). On November 17, 2020, CTP responded (Dkt. #16). On November 25, 2020, PetSmart replied (Dkt. #17).
