Pending before the Court is Defendant’s Motion to Dismiss the Amended Complaint For Failure to State a Claim (Dkt. #11). Having considered the motion and the relevant pleadings, the Court finds the Motion should be DENIED. BACKGROUND On March 6, 2020, Plaintiff Intelligent Agency, LLC sued Defendant 7-Eleven, Inc. (Dkt. #1). On July 20, Plaintiff filed its Amended Complaint (Dkt. #9). On August 3, Defendant filed its Motion to Dismiss (Dkt. #11). On August 17, Plaintiff responded (Dkt. #16). On August 24, Defendant replied (Dkt. #17).
