Pending before the Court is Plaintiff’s Motion to Dismiss Counterclaims (Dkt. #31). The Court, having considered the relevant pleadings, finds that Plaintiff’s motion should be denied. On June 3, 2016, Plaintiff filed a motion to dismiss (Dkt. #31). On June 22, 2016, Defendant Samsung Electronics America, Inc. (“SEA”) filed a response (Dkt. #36). On July 5, 2016, Plaintiff filed a reply (Dkt. #37). On July 18, 2016, SEA filed a sur-reply (Dkt. #41).
