Before the Court is Defendant Cisco Systems, Inc.’s Motion to Dismiss Plaintiff’s Action Pursuant to Federal Rule of Civil Procedure 12(b)(1) for Lack of Standing. Docket No. 26. This case was referred to United States Magistrate Judge Roy Payne pursuant to 28 U.S.C. § 636(b)(1). On February 2, 2026, t he magistrate judge issued a report and recommendation, recommending that the motion be denied. Docket No. 76. On February 17, 2026, Defendant filed its objections to the report and recommendation. Docket No. 77.
