Before the Court is Defendant Amazon. com, Inc.’s (“Amazon”) Motion to Dismiss (“Motion”). (Dkt. No. 23). In the Motion, Amazon moves to dismiss Plaintiff Lexos Media IP, LLC’s (“Lexos”) claims that Amazon infringes U.S. Patent Nos. 5,995,102 (the “’102 Patent”) and 6,118,449 (the “’449 Patent”) (together, the “Asserted Patents”) (Dkt. No. 12 at ⁋⁋ 29–61). Having considered the Motion and briefing, the Court finds the Motion should be DENIED for the reasons set forth herein. I.
