Before the Court is Defendants’ 1 Motion for Summary Judgment No. 1: Non- infringement Due to Application of the Festo Bar (Dkt. No. 165). For the following reasons, the motion should be GRANTED. I. BACKGROUND On February 3, 2022, Howlink filed suit against Defendants alleging that they infringe U.S. Patent Nos . 8,630,279 (the “’ 279 Patent”), RE46,415 (the “’415 Patent”), and 9,596,576 (the “’576 Patent” ). Since filing this suit, Howlink has decided it no longer assert s the ’415 Patent,2 and the ’576 Patent.
