Before the Court is Defendant Ciena Corporation’s (“Ciena”) Motion to Dismiss or in the Alternative Transfer Based on Improper Venue and Convenience (Dkt. No. 5) seeking dismissal for improper venue under 28 U.S.C. § 1400(b) or, in the alternative, transfer to the Northern District of California for convenience under 28 U.S.C. § 1404(a). Having considered the Parties’ submissions and the relevant authorities, the Court is of the opinion that Ciena’s Motion to Dismiss for Improper Venue should be and is hereby DENIED.
