Before the Court is Defendant Citizens National Bank’s Motion to Dismiss for Failure to State a Claim pursuant to Federal Rule of Civil Procedure 12(b)(6) ( “Motion,” Dkt. No. 14 in Case No. 2:15- cv-1955). Also before the Court are substantially similar motions filed by Defendants ZB, N.A. f/k/a Amegy Bank N.A . and Commercial Bank of Texas, N.A. (Dkt. No. 8 in Case No. 2:15- cv-1936 and Dkt. No. 8 in Case No. 2:15- cv-1971, respectively ).
