CONSTRUING CLAIM TERMS OF UNITED STATES PATENT NO. 5,344,666 Defendant Alpha Scientific C orp. (“Alpha”) is the owner of United States Patent No. 5,344,666 (“the ' 666 patent”). Plaintiff Helena Laboratories Corp. (“Helena”) makes and sells liquid dispensers throughout the United States. The present action was brought by Helena under the Declaratory Judgment Acts, 28 U.S.C. § 2201 et seq. in response to a letter from Alpha’s counsel stating that Helena ’s produc ts infring e the ` 666 patent and de manding that such infringement cease.
