This case comes to us on appeal for a third time. Zinus, Inc. appeals the U nited States District Court for the Cen- tral District of California’s summary judgment of invalidity under the on -sale bar, 35 U.S.C. § 102(a)(1), (b)(1). Be- cause there are material factual disputes regarding whether the on -sale product anticipates the asserted claims of U.S. Patent No. 8,931,123, we vacate the district court’s summary judgment and remand.
