Sociedad Espanola de Electromedicina y Calidad, S.A. (“SEDECAL”) appeals the district court’s construction of certain claim terms of U.S. Patent No. 6,642,829 (the “’829 patent”) and its grant of Blue Ridge X -Ray Co., DRGEM USA, Inc. and DRGEM Corp. ’s (“Blue Ridge ’s”) motion to amend their invalidity contentions pursuant to which the district court granted summary judgment that the asserted claims of the ’829 patent a re invalid and not infringed.
